Accommodation availability
Whilst we will take all reasonable steps to ensure that the accommodation you have reserved is available on your arrival at Loch Monzievaird, no guarantee can be provided. Therefore in the unlikely event that the accommodation or it's facilities are damaged by fire, explosion, storm, flood, burst pipes, malicious damage or any other circumstances beyond our control; (or if your booking was made prior to the 31st of October (preceding year) in one of our quarter ownership chalets and subsequently (prior to 31/10) required by a quarter owner), we reserve the right to relocate you to another chalet of a similar size and quality to the one which you had originally booked. In the event that no other suitable accommodation can be provided, we will reimburse your rental in full and (if no reasonable notice of the unavailability of your original choice of accommodation had been provided prior to the commencement of your journey), your reasonable travelling expenses.
Force majeure.
We cannot accept responsibility or pay any compensation where the performance or prompt performance of our contract with you is prevented or affected by reason of circumstances, which amount to ‘force majeure’. Circumstances amounting to ‘force majeure’ include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the property (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage or any similar event beyond our control. Such circumstances also include riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity and all similar situations beyond our control.
Smoking
Smoking is strictly prohibited in all of our accommodation. Most chalets have covered balconies which are designated as smoking areas. Removal of smoke odours in buildings is extremely difficult. Charges will be taken from deposits if it is found that smoking has been allowed.
Pets at Loch Monzievaird
Dogs at Loch Monzievaird Outside If your dog does not walk to heel it must be on a lead in the immediate grounds. Some people are not as used to dogs as others, young children in particular can be very frightened by dogs running up to them however harmless the intention. Please be aware that there are farm animals in the surrounding fields. Please do not allow your dog to foul the areas in the immediate vicinity of your accommodation. All dog waste must be collected. Inside the buildings Dogs must never be left unattended in your accommodation unless caged. Dogs must never be allowed into the bedrooms or onto any of the furniture. Dog owners are required to make an extra effort before leaving their accommodation including vacuuming up all dog hairs, leaving windows open to air the building and checking carefully around the building for waste. Additional charges will be made to client accounts where this is not found to be the case.
Safety Whilst we have attempted to make Loch Monzievaird as safe as possible, there are natural hazards associated with a rugged highland location such as this. Ultimately, responsibility for your well being (and that of any of your children or pets) lies with you.
Travel & Weather At times of adverse weather (notably snow) the main A85 is well maintained. We aim to keep our entrance road and the main access tracks clear, but at rare times of heavy snow, direct "to the door" access to all of our accommodation may not be possible. Where there are travel disruptions as a result of bad weather or fuel shortages, Loch Monzievaird cannot be held responsible for non-arrival.
Damage, Loss & Nuisance The management reserves the right to refuse admission of persons for any just reason. Similarly, the management reserves the right to evict offensive persons or pets. No refunds will be made. The hirer agrees to pay for any damage or loss, excluding reasonable wear & tear incurred during their occupation. The management reserves the right to make additional charges to deposits or credit cards or to invoice for damages.
Vehicles: vans, cars, bicycles, trailers and their accessories and contents are left entirely at their owners' risk. The proprietors will not be responsible for any loss or damage thereof or thereto from any cause whatsoever.
Your Booking is not confirmed until you have received an official booking confirmation from us. Your booking is limited to the numbers of persons stated on your booking form. Casual overnight guests are not permitted unless agreed in advance with the management.
Good Housekeeping Deposit
For weekly and short break bookings a deposit of £100 per unit is payable on booking (Group and Long term bookings by arrangement). The deposit secures your booking and is held as an inventory & cleaning deposit for the duration of your stay, and excepting cancellation will be repaid in full in the week following your departure, if no breakage or damage occurs, and your accommodation is left in a clean and tidy condition
(as above) less any charges for cleaning, electricity (winter season - weekly bookings), grocery orders, milk or newspapers.
Final Payments
Accounts are due for payment 8 weeks prior to arrival. If you plan to take your holiday within 8 weeks of your booking, payments must be made in full at the time of booking.
We accept cheques, debit cards and credit cards.
Rent Waiver (previously called Cancellation Insurance)
(for weekly bookings paid more than 8 weeks in advance- unless specifically requested otherwise) Details of cover as follows: To protect your advance letting payment we enter your booking into our Rent Waiver scheme, so that if after you have paid your letting fees you have to cancel (for one of the reasons below) your letting fee will be covered.
It should be noted that a simple change of plan does not constitute a claim under the scheme.
1) If after payment of your letting fees (due 8 weeks prior to the start of your holiday), you are forced to cancel because of illness, death, injury, maternity or illness of any member of your party (marked on your Booking Form), Witness call or Jury Service by you or your wife or because of your own redundancy (qualifying for payment under the Redundancy Payment Act 1965) or because of your own military service posting resulting in cancellation of leave or because of death or serious injury or illness of a close relative* or death of a business associate partner or co-director, and you can provide supporting documentary evidence, and has arisen since you made the booking, then you will be refunded 100% of letting fees paid, only your booking deposit & the charge for Rent Waiver will be forfeit. To qualify you must notify us in writing immediately the circumstances arise.
Our acknowledgment in writing to you will be evidence of our having received your notification.
In case of multiple or party bookings (i.e.. where more than one unit of accommodation is booked at the same time), cover extends to one unit only or to units booked by close relatives where the Rent Waiver has been paid for that unit also.(*close relative means the husband, wife, father, mother, father-in-law, mother-in-law, brother, sister, child or dependant of the person in whose name the booking is made).
2) If after payment of your letting fees you are forced to cancel and your reason is not one of the qualifying reasons as shown above, you will forfeit your booking deposit and your letting fees. We will however attempt to relet the property even at short notice and where we are successful we will refund the letting fees less a fixed charge of £100 per week.
The decision of Loch Monzievaird on all claims will be final
